Notification and information to the local administration of Trieste as for the status of the Free Port of Trieste

Subject: Notification and information to the local administration of Trieste as for the status of the Free Port of Trieste.

The administration of the city of Trieste has announced to public opinion its intention to enforce immediate measures to remove from State Property an to illegali urbanize the Northern Free Port of Trieste, under sub-paragraphs 618, 619 and 620, which were added for tis purpose to the Italian Financial Law for year 2015, passed by the Italian Parliament on December 23rd,  2014.

This is why the Free Trieste Movement – Movimento Trieste Libera notifies the local administration and it informs, for all legal intents and purposes, that:

1. The subject is notoriously regulated by the instruments of international law, which do completely subtract the matter to the competence of the Italian Parliament, as well as of both Region Friuli Venezia Giulia and of the City Council of Trieste, as these laws entrust it to the Italian Government, with the role of temporary civil administrator of the Free Territory of Trieste, in accordance and within the limits of the mandate of special trusteeship, as well as to respect the rights of all other States as for the use and management of the international Free Port of Trieste.

2. Therefore, the above mentioned sub-paragraphs 618, 619 and 620 of the Stability Law for year 2015 are anti-constitutional, as these violate both Article 10, sub-paragraph 1 and Article 117, sub-paragraph 1 of the Constitution of the Republic of Italy, as these new norms violare both the provisions of international law and specific, international obligations of the State of Italy.

3. Ad abundantiam, the above mentioned sub-paragraphs could not be enforced anyways, as these do roughly violate even the Italian legislation on ports and on local authorities.

4. As for the political-administrative activities for the removal from State Property and the illegal urbanization of the Northern Free Port, there are pending complaints and criminal investigations, as well as anti-corruption and anti-mafia alerts.

5. The correct, legal framework of the question of the international Free Port of Trieste is that in the annexed act of “Formal international notice to the Italian Government entrusted with the administration of the Free Territory of Trieste to fully implement the norms concerning the international regime and the naval registers of the Free Port of Trieste”, etc.
